Terms of use for the trial version

1. Subject

These terms govern the use of the software “Emmoke Finanzplan” (Windows program and app, the “Software”) as a free trial version. The Software is currently not sold; there are no costs and no subscription. By downloading and installing it you agree to these terms.

2. Right of use

You receive a simple, non-transferable right, revocable at any time, to use the Software free of charge for a trial period of 30 days. The trial can be extended twice free of charge by 30 days each in the program; further extensions are free on request. Copying for distribution, renting, selling, reverse engineering (unless permitted by law) and modifying the Software are not permitted.

3. Trial / pre-release version

The Software is under development. Features may change, be removed or contain errors. There is no entitlement to updates, support or permanent availability. Please back up your data regularly (e.g. on a USB stick) and do not use the trial version as the only storage of important documents.

4. Data and privacy

All data is stored encrypted only on your device or in a cloud folder you choose. The provider has no access. You are responsible for backups and for keeping your password and recovery key safe. Without password and recovery key the data cannot be restored – not even by the provider. Details: Privacy.

5. No tax or legal advice

Calculations, ratings, price comparisons, notes, templates (e.g. cancellation or objection letters) and form preparation are for planning and orientation only. They do not replace tax or legal advice. Check results before any use, especially towards the tax office, authorities or contract partners. You are responsible for decisions you make on the basis of the Software.

6. Liability

As the Software is provided free of charge, the provider is only liable for intent and gross negligence and for fraudulently concealed defects (§§ 521, 524, 599, 600 German Civil Code, BGB). Liability under the German Product Liability Act remains unaffected. For data loss the provider is only liable to the extent that would have occurred with regular data backups by the user.

7. Trademarks

Trademarks and product names mentioned (e.g. ELSTER, Microsoft, Windows, Outlook, OneDrive, Google, Android, Apple, iPhone, iCloud) belong to their respective owners. Emmoke is not affiliated with these owners.

8. Final provisions

German law applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
